CROSS THE SEAMS PRIVACY POLICY

This Privacy Policy (this “Policy”) describes how Cross the Seams Baseball & Softball Training LLC (“we,” “us,” or “CTS”) processes personal information in relation to your use of our website found at crosstheseams.com (the “CTS Site”), or your participation in evaluations, training programs, or lessons (“Program Activities”). Program Activities may be provided by CTS, or Program Activities may be provided by independent, individual instructors who license and use CTS developed teaching curriculum in connection with coaching players in baseball and/or softball (“Instructors”). Instructors are not affiliated or endorsed by CTS in any way; however, some Instructors may utilize a website to communicate with CTS members under their instruction, provide access to Materials, and to schedule evaluations, training programs, lessons, and payment (“Instructor Sites”). You may use the CTS Site (or Instructor Sites, where applicable) for, among other things, registering or subscribing as a member, inquiring about a licensing agreement, accessing instructional material, inquiring about, registering for, or scheduling Program Activities, making payments, communication, purchasing merchandise, and accessing training content. Members can also access a membership portal through the CTS Site or an Instructor Site, which provides access to certain CTS training and education materials (“Materials”). The membership portal is powered by a third party, Coach IQ. The CTS Site and membership portal are collectively referred to in this policy as the “Platform.”

1. Policy Scope; Consent

This Policy describes how CTS collects, uses, shares and protects personal information. It applies to the collection by CTS of information through the Platform. This Policy applies only to CTS’s own data practices, and not to the practices of third parties that we do not control. Please note that we license teaching curriculum to Instructors who have their own separate privacy practices, which may involve collecting and handling your personal information in different ways. We also utilize a membership portal, powered by a third party, Coach IQ, to provide members access to certain CTS Materials. This Policy applies to information collected through the CTS Site and through the membership portal accessible from either the CTS Site or any Instructor Sites that post this Policy; however, this policy does not govern information you provide to an Instructor directly, or information that an Instructor may collect through an Instructor Site outside of the membership portal. Instructors agree to follow the terms of this Policy with respect to information collected or received through the membership portal, but we do not control the information an Instructor may otherwise collect through an Instructor Site or their privacy practices with respect to the handling of such information. 
By using or accessing the Platform, or participating in Program Activities, you agree to the terms of this Policy. You should read this Policy carefully, so that you understand our privacy practices. By continuing using the Platform or Program Activities, you confirm that you have read, understood, and agreed with this Policy.This Policy identifies our practices concerning the collection of certain personal information from you, the purposes of that collection, and the sources from which we collect such information. As used in this Policy, "personal information" or "personal data" means information that identifies or could reasonably be linked, directly or indirectly, with a particular individual or household. 

2. How we collect information

a. Information you provide. For certain inquiries, communications, and Program Activities, such as when you contact us via the CTS Site, sign up for a membership or subscribe or register for a CTS account through the membership portal, inquire or register for our a CTS-provided training program, schedule an evaluation or training session with CTS, download or access our Materials or content from the membership portal, or contact CTS directly, CTS may collect some or all of the following categories of personal information: username, student and parent/guardian first and last name, age, phone number, email address.   We also collect certain payment and billing-related information through the Platform if you sign up for a membership or other fee-bearing services, or if you purchase merchandise. We will collect payment information from you at the time of a transaction for the purpose of completing transactions to establish a CTS membership, obtain goods or merchandise, and to schedule Program Activities via the Platform. CTS does not store credit card information on our servers. We utilize third party-operated payment service(s), including Stripe, to process your payment. Your Instructor may collect payment from you directly for Program Activities you receive from an Instructor and CTS is not responsible for Instructor’s payment collection practices in such instances.   You may be able to provide additional information about athletic performance or information or videos relating to softball or baseball training to CTS and your Instructor. With respect to videos submitted through the Platform, CTS and your Instructor have access to such videos, but CTS does not share them outside of the Platform and the Platform’s authorized users, without permission.  
b. Information we collect automatically: We may collect information about how you use the Platform, such as device information, which may include your IP address, browser types, browser language, operating system, platform type, device types, and device IDs such as unique identifiers or advertising identifiers; usage information, which may include files you download, domain names, landing pages, your browsing activity, pages viewed, advertising viewed or visited, forms or fields you complete or partially complete, search terms, access times, and error logs, and other similar information; location information; viewing behavior, which may include the content you view, how long you watch each video, the quality of the service you receive (e.g. buffering, load times) as well as advertisements you have been shown or interacted with.
c. Information we collect from third parties. We may receive information about you when you interact with CTS and Instructors through various social media, for example, by liking us on Facebook, following us on X (formerly Twitter), or connecting on Instagram, Vimeo, or other social networks. The data we receive is dependent upon your privacy settings with the social network. You should always review, and if necessary, adjust your privacy settings on third-party websites and services before linking or connecting them to the CTS Site or other portions of the Platform.
d. Instructor Provided Information. Instructors may provide us information about you when you schedule Program Activities to permit CTS to confirm individuals participating in Program Activities have also obtained a CTS membership when required.   
e. Instructor Practices. Instructors that license CTS curriculum (and other individuals or organizations you choose to share information with) may have their own data collection and use policies that we do not control, even in situations where we may facilitate access to or maintain such data on behalf of the Instructors through our membership portal. Please review the privacy policies of any third-party person or organization before sharing your personal information with that person or organization.

3. Data Use

We may use, share, or otherwise disclose the personal information we collect for one or more of the following purposes: • To fulfill or meet the reason for which the personal information is collected. • To respond to inquiries about CTS, Program Activities, and Instructor licensing inquiries.  • To communicate via phone, email, or SMS alerts and to provide other notices concerning our Services. • To connect you with an Instructor or member in your area.  • To confirm individuals who are participating in Instructor provided Program Activities have obtained a CTS membership.  • To facilitate you registration or subscription as a member and to schedule Program Activities.  • To communicate about news and opportunities that may be of interest to you.  • To fulfill purchase orders and ship merchandise to you. • To improve our Platform for you and other users. • For testing, research, analysis and product development (for example, CTS may collect information on visits to the CTS Site, use of the Materials, and participation in Program Activities). • To protect the rights, property or safety of us, our members, Instructors, or others. • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations. • To carry out legal obligations and enforce our Terms of Use. • To evaluate or conduct a merger, divestiture, restructuring, financing, refinancing, reorganization, dissolution, or other sale or transfer of some or all our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us is among the assets transferred. • For additional purposes consistent with this Policy or with your consent. 

4. Data Sharing  

We may share your personal information in the instances described below without providing separate or additional notice to you.  • We may share your personal information with Instructors who license the CTS curriculum, for example to facilitate and permit you to communicate and schedule training and evaluations with those Instructors using their Instructor Site. CTS and your Instructor will have access to information (including videos and communications) that you submit via the Platform. • Information submitted through the membership portal on an Instructor Site is maintained by and/or shared with CTS to carry out the Data Use purposes outlined above. • We may disclose your personal information to website hosting partners, affiliates, service providers, contractors and other parties who assist or support us in: (i) operating our CTS Site and otherwise providing our Platform (including where we utilize third-party service providers to manage content, provide research and analytic services, process payments, fulfill merchandise orders, host our CTS Site, and to make Materials accessible on the Coach-IQ powered membership portal); and (ii) conducting our business in connection with the provision of services and the Platform to you (such as payment processing and data storage), or in otherwise servicing your membership or account. Our service providers use personal information to provide us with their services. • We may release your personal information: to comply with any court order, law, or legal process; to enforce our Terms of Use, agreements, and legal rights; to protect ours or others' rights, property, privacy, or safety; to protect against fraudulent, deceptive, or illegal activity or for risk management; to permit us to pursue available remedies, commence, participate in, or defend litigation, or limit the damages that we may sustain. • We may share your personal information with other parties in connection with a company transaction, such as a purchaser or successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of CTS’s assets or shares, whether as a going concern or as part of bankruptcy, liquidation, or similar proceedings.  • We may share aggregated and deidentified information with third parties for their own uses. • Marketing and Promotional Emails  We may use your personal information to send you marketing and promotional emails, newsletters, or other information that may be of interest to you. We use an email service provider for purposes of managing and providing these communications. You may opt out of receiving email marketing communications by using the unsubscribe link in our email communications. Please allow us reasonable time to process before you opt-out request. Also note that even if you opt out of receiving email marketing communications from us we may still use your email to contact you for non-marketing purposes such as facilitating Program Activities, membership communications, merchandise fulfillment and shipping, notices, or to fulfill legal obligations. • How We Protect InformationCTS uses security safeguards we consider to be reasonable and appropriate to preserve the integrity and security of personal information we collect. CTS cannot warrant or guarantee the security of your personal information as no electronic storage system or data transmission can be guaranteed to be 100% secure.   • Cookies and Tracking CTS may use the following technologies to collect data as you visit the CTS Site and use the Platform.  “Cookies” are small pieces of data that a website, when visited by a user, asks your browser to store on your device to remember information about you, such as your language preference or login information. Cookies set by CTS are called first party cookies. Third party cookies are cookies from a domain different than the domain of the website you are visiting. Cookies can be either persistent or temporary. A persistent cookie retains user preferences for a particular website, allowing those preferences to be used in future sessions and remains valid until its set expiry date (unless deleted by the user before the expiry date). Temporary cookies expire at the end of a user session when the browser is closed. Most internet browsers are initially set to accept cookies. Cookies are classified in the following categories: Necessary Cookies, Performance Cookies, Functional Cookies, and Targeting Cookies. You cannot opt-out of Necessary Cookies, but you can opt out of the other cookie categories by clicking on the “cookie settings” button in your browser, in this policy, or in the applicable website cookie notice. If you decline the use of cookies or set your browser to refuse cookies, then you may not be able to access or use portions of this CTS Site or Platform. “Web beacons” and “pixels” are small bits of code embedded in web pages or emails that assist in delivering cookies and measuring statistics. Web beacons and pixels help CTS determine whether a page has been viewed and, if so, how many times. CTS may also use web beacons and pixels in email messages to determine what the recipient has done with the message. Although you cannot decline to receive web beacons and pixels when visiting a web page, you can choose not to receive them by email if you disable HTML images or refuse HTML email messages.  Shopify. Our CTS Site includes cookies placed by our e-commerce platform provider, Shopify. When you visit or use the CTS Site, Shopify places cookies on your computer or device. Shopify uses several different cookies, including strictly necessary, performance, advertising, and social media or content cookies. To read more about these cookies and other similar tracking technologies used by Shopify on our websites please visit: https://www.shopify.com/legal/cookies.Google Analytics. The Platform may use Google Analytics. Google Analytics assists CTS with collecting and monitoring data about website traffic and usage. Google Analytics collects visitation information and identifiers via browser cookies. We use Google Analytics for search term optimization, content analysis, website development, and improving the online shopping experience for CTS Site visitors. If you would like to opt-out of the collection of data by Google Analytics, visit https://tools.google.com/dlpage/gaoptout/.  For information about Google Analytics’ currently available opt-outs, visit the following website: https://tools.google.com/dlpage/gaoptout/.  For more information about how Google uses, stores, and discloses your personal information, visit Google’s Privacy Policy: https://policies.google.com/privacy. We may permit third party ad networks, social media companies, and other third-party services (for example, Facebook, Instagram, YouTube) to collect information about browsing behavior from visitors to our Platform through cookies, social plug-ins, or other tracking technology. We may permit third party online advertising networks to collect information about your use of our websites over time so that they may play or display ads that may be relevant to your interests on our Platform as well as on other websites or services. Typically, the information is collected through cookies or similar tracking technologies. The only way to completely "opt-out" of the collection of any information through cookies or other tracking technology is to actively manage the settings on your browser or mobile device. Please refer to your browser's or mobile device's technical information for instructions on how to delete and disable cookies, and other tracking/recording tools. Depending on your mobile device, you may not be able to control tracking technologies through settings.By visiting our CTS Site or otherwise using our Platform, whether as a member, registered user, or otherwise, you acknowledge, and agree that you are giving us your consent to track your activities in connection with the Platform and your use of the Platform through the technologies described above, as well as similar technologies developed in the future, and that we may use such tracking technologies in the emails we send to you. Third parties may themselves set and access their own tracking technologies when you visit our Platform, and they may have access to information about you and your online activities over time and across different websites or applications when you use a Platform. Third parties' use of such tracking technologies is not in our control and is subject to such third parties' privacy policies. • The Site does not respond to web browser Do Not Track (DNT) signals. 
• Children Under the Age of 13OUR SITE IS INTENDED TO ENABLE PARENTS AND OTHER ADULTS TO LEARN ABOUT CTS, REGISTER AND MANAGE THEIR OWN CTS MEMBERSHIP, AND FACILITIATE THEIR CHILDREN'S PARTICIPATION IN BASEBALL AND SOFTBALL-RELATED ACTIVITIES. IF YOU WISH TO PROVIDE YOUR CHILD UNDER THE AGE OF 13 WITH DIRECT ACCESS TO OUR SITE OR MEMBER CONTENT, PLEASE READ THIS CHILDREN’S PRIVACY SECTION CAREFULLY BEFORE ALLOWING YOUR CHILD(REN) ACCESS.The Children’s Online Privacy Protection Act of 1998 and its rules (collectively, "COPPA") require us to inform parents and legal guardians (as used in this policy, "parents") about our practices for collecting, using, and disclosing personal information from children under the age of 13 (“children”). It also requires us to obtain verifiable consent from a child's parent for certain collection, use, and disclosure of the child's personal information.This section notifies parents of: • The types of information we may collect from children. • Our practices for notifying and obtaining parents' consent when we collect personal information from children, including how a parent may revoke consent. • How we use the information we collect. • Our practices for disclosing that information. • Operators that may collect or maintain information from children through the PlatformThis section only applies to children under the age of 13 and supplements the other provisions of this Policy. Only the other provisions of this Policy apply to teens and adults. BY USING OR ACCESSING OUR PLATFORM, OR BY PERMITTING YOUR CHILD TO ACCESS OUR PLATFORM, YOU ARE ACCEPTING THE PRACTICES DESCRIBED IN THIS POLICY. • Information We Collect from Children • Children can access and use many parts of the CTS Site without providing their personal information. However, some content and features of the Platform, including the membership portal, are available only to registered members or require us to collect certain information, including personal information, about players. Our primary form of collection of information about children comes from the information we receive from a parent or guardian to permit their child’s participation in Program Activities. In addition, we use certain technologies, such as cookies, to automatically collect information from our users when they visit or use the Platform. • We collect information about a child that is reasonably necessary for the child to participate in an activity, and we do not condition his or her participation on the disclosure of more personal information than is reasonably necessary. • Parental Consent Required for Access to Member Content A Parent will have the option to do some, if not all, of the following: • Create a member account that includes personal information for parent and player. • Register your child online for participation. • Receive certain notifications, email or text from other users of the Platform. • Share photographs or videos of your child through the Platform. • Make credit card or other payments online. • View and access training curriculum.Children are not allowed to access portions on the CTS Site or Platform that require a member account and login without a parent’s permission. Children may not subscribe to or create their own member account with CTS. Children may only have or access a member account that is established by, and with the permission of, a parent or legal guardian.We enable registered members to communicate with Instructors and other users on or through the Platform, which may include use of email or messaging ("Social Features"). The nature of these features allows children to disclose personal information about themselves if a parent has given the child access to use the parent’s member account. We do not monitor or review this content before it is shared, and we do not control the actions of Instructors or other third parties with whom your child communicates or shares his or her information. We encourage parents to educate their children about safe internet use and to monitor their children's use of Social Features.
• Automatic Information Collection and TrackingWe use technology to automatically collect information from our users, including children, when they access and navigate through the Platform and use certain of its features. The information we collect through these technologies may include IP address. For information about our automatic information collection practices, including how you can opt out of certain information collection, see the "Cookies and Tracking" section of this Policy.
• Parental ConsentCTS is required to use reasonable efforts to ensure that before we collect any personal information from a child, the child’s parent receives notice of and consents to our information practices. Children may not participate in Program Activities without a parent’s permission. We obtain parental consent through the parent’s registration and payment for a CTS membership, and payment for their child’s participation in Program Activities. • Tracking Activities on the Site  • We may track user’s activities within the CTS Site or Platform. For example, we may track the pages visited, the length of time spent logged in, the information submitted about preferences and comments posted via the Platform. This information may be associated with your member account and may be combined with the personally identifiable information we collect from you as a member. • We may partner with third parties to provide content and/or to display targeted advertisements. We will not share your child’s personally identifiable information with these third parties. However, some of these third parties may use tracking technologies, such as cookies and Web beacons, in order to track user activity. We do not exercise control over or have access to these tracking technologies or the information practices of these parties, which are subject to the privacy policies of these third parties. • How We Use Your Child's InformationWe use your child’s personal information to:Register him or her for an evaluation with parent permission.Communicate with you about activities, training materials, or features of the Site that may be of interest.Register or schedule him or her for Program Activities with Parent permission. Track progress on Materials and training curriculum accessed through the parent’s member access. • Our Practices for Disclosing Children's InformationWe do not share, sell, rent, or transfer children's personal information other than as described in this Policy. We may share or disclose children’s personal information as described in this Policy. See the Policy section titled “Data Sharing.” • Operators That Collect or Maintain Information from ChildrenParties that may collect or maintain personal information from children through the Site or Platform, include:  • Coach IQ (privacy policy available at https://www.coachiq.io/) • Independent Instructors who license CTS teaching curriculum and utilize an Instructor Site to provide access to the CTS membership portal in connection with Program Activities. (Instructor listing available at (https://crosstheseams.com). • Parental RequestsParents may request information from us on the type of data being collected, view their child’s information, and, if they choose, prohibit us from making further use of their child’s information. For more information on how to do this, see the section below entitled “How To Review or Delete the Information Collected From Your Child.” • How To Review or Delete the Information Collected From Your Child You can review your child’s personal information by logging into your member profile. You can have your child’s personal information deleted and stop further collection of such information by us. If you wish to view, delete or modify the information we have collected about your child or disable or delete your member profile, you may e-mail us at the email address below. However, please understand that, even after removal, member content may remain viewable in cached and archived pages or by others if an Instructor has copied or stored such content. • For Nevada ResidentsUnder Nevada law, Nevada residents may submit a request directing us not to make certain disclosures of personal information we maintain about them. If you are a Nevada resident and wish to exercise this right, you may contact us by email at the email address listed below. • California “Shine the Light”  California residents that have an established business relationship with us have rights to know how their information is disclosed to third parties for their direct marketing purposes under California’s “Shine the Light” law (Civ. Code § 1798.83). CTS cannot be held responsible for third parties’ privacy practices or content provided on such websites. If you click on one of these links, please understand that you are leaving the CTS Site and any information you provide will not be covered by this Policy. Please refer to any third-party website’s privacy policy for information on their privacy practices.  • Changes to this PolicyThis Policy is effective as of the Effective Date above. We reserve the right to change this Policy (including the section on Children Under the Age of 13) at any time. We will advise you of material changes to this Policy by posting the revised Policy on our CTS Site. We recommend that you review this Policy from time to time to obtain the current version.
